Terms of Service

1. Custom Orders & Manufacturing

• Custom Build Process: Our arcade cabinets are custom built-to-order based on your selected hardware, graphics, and physical specifications.
• Production Timelines: Production and build estimates provided on the website or via customer support are approximations and may vary depending on component availability, custom artwork approvals, or shipping logistics.
• Order Modifications: Changes to graphics, control configurations, or hardware layouts after order confirmation may be subject to additional fees or lead-time adjustments.

2. User Accounts & Dashboard Access

• Account Creation: To track build progress, monitor delivery status, or submit support tickets, you may be required to register an account. You agree to provide accurate and complete information.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Pricing, Payments & Third-Party Financing

• Pricing: All prices are listed in the stated currency at checkout and are subject to applicable taxes, freight, and shipping charges.
• Payment Processing: Payment processing is handled by third-party payment gateways, including Stripe. We do not process or store financial card information on our servers.
• Amount Due: All Stripe payments, including eligible financing, require the full order total upfront to Mectura. The 50% build deposit is available only by Interac e-Transfer from a Canadian bank account. The remaining 50% is due when your arcade is complete and must be paid before pickup or delivery. Both amounts include applicable HST.
• Third-Party Financing: If you elect to use third-party "Buy Now, Pay Later" (BNPL) or financing tools available at checkout, the full purchase amount is paid to Mectura through the provider once payment succeeds. You repay the provider under its separate agreement, interest rates, and payment schedule; financing does not require you to repay the entire loan upfront.

Custom Build, Cancellation, and Refund Terms

• Before Production: If you cancel before custom production begins, payments made toward your order, including a 50% build deposit or full payment, are fully refundable.
• After Production Begins: Once custom production begins, payments made toward your order are non-refundable, except where required by law.
• Requesting Cancellation: Contact Mectura at contact@mectura.com with your order number to request cancellation or confirm whether production has begun.
• Financed Orders: Any approved refund is handled through the financing provider. The provider applies the refund and adjusts repayments under its agreement. Contact the provider about payment obligations while a refund is being processed.
• Your Rights: This policy does not limit any cancellation, refund, warranty, or other rights you have under applicable law.

4. Shipping, Delivery & Freight

• Delivery Responsibility: Large arcade cabinets are shipped via parcel or freight carriers. Delivery dates are estimates provided by carriers and are not guaranteed.
• Freight Inspection: Upon delivery, you are required to inspect the exterior packaging and arcade unit before signing off with the carrier. Any shipping damage must be noted on the carrier's Bill of Lading (BOL) and reported to us immediately via our support ticket system.

5. Warranties & Serial Number Tracking

• Warranty Coverage: Custom cabinets include coverage for technical build defects and hardware performance as specified in your order documentation.
• Serial Number Logs: We maintain internal records of hardware serial numbers for warranty validation, support verification, and anti-fraud purposes.
• Exclusions: Warranties do not cover damage resulting from unauthorized hardware modifications, software tampering, improper physical movement, electrical power surges, or normal cosmetic wear and tear.

6. Intellectual Property & Custom Artwork

• Brand Assets: All content, logos, site design, text, software, and original graphics on mectura.com belong exclusively to Mectura Gaming.
• Customer Artwork: If you supply custom artwork, images, or logos for application to side panels, marquees, or control decks, you represent and warrant that you hold the legal rights, licenses, or permissions to use those images.

7. Limitation of Liability

To the maximum extent permitted by law, Mectura Gaming shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our website or products, including but not limited to loss of data, loss of business, or hardware damage resulting from unauthorized alterations.

8. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal disputes shall be brought exclusively in the courts located in Ontario, Canada.
